Kraham: Of course it's political
The ultra-Orthodox, and often Republican, Village of Kiryas Joel found support coming from what may seem unexpected quarters of the Orange County Legislature last week: That of Democratic lawmaker Bonnie Kraham.
While Kraham, who represents parts of Goshen, Middletown and Wallkill, voted to oppose the Hasidic village's contentious New York City aqueduct tap, she cautioned against a rush to judgment and advocated opening a community dialogue between Kiryas Joel and its neighbors.
Word of Kraham's carefully nuanced position began to circulate among members of the grassroots coalition opposing the pipeline even before she had a chance to speak on the floor. Kraham, you see, is the Democrats' endorsed candidate for the Republican-heavy 97th Assembly District, and some feared she had succumbed to the temptation of having Kiryas Joel's bloc vote in November.
So does that play in, really?
"Of course it does," Kraham said before the meeting started. "I'm in a race for a district that includes Kiryas Joel and Monroe. They would be my constituents if I were elected."

KJ still prefers peace
After taking a 20-1 pounding in the Legislature on an issue the people of Kiryas Joel consider a matter of survival – a $29 million water pipeline from the New York City Aqueduct – village leaders were not happy.
Instead of being accepted by the Legislature, which had so often accommodated them in the past, they felt "condemned" and "stabbed in the back." In a letter, Mayor Abraham Wieder even likened the Legislature to a "kangaroo court." Nonetheless, Kiryas Joel Administrator Gedalye Szegedin, the Hasidic village's increasingly public face, was not ready to close the door on compromise."We don't take one blow and translate that into a declaration of warשהטקסט שלך כאן

Kiryas Joel – Besieged by critics hoping to stop its proposed water pipeline and eventual expansion, this fast-growing Hasidic community is quickly developing plans to incorporate a second village outside its borders to safeguard its future.
Vaad Hakiryah, a major landholding company that acts as Kiryas Joel's development arm, is leading an effort to form a municipality that could equal or exceed the size of the existing, 1.1-square-mile village, according to a Kiryas Joel official who spoke on condition of anonymity.
Dennis Lynch, a Nyack lawyer who represents Vaad Hakiryah, confirmed he's been "engaged to immediately proceed with a village incorporation effort" in or near Monroe, Woodbury and Blooming Grove, the towns surrounding Kiryas Joel.
He wouldn't say who his client was or discuss the plans further. But he vowed: "This effort will establish a record in time and successful completion."
The proposal could prove explosive in the region, setting up a race with non-Hasidic groups already seeking to cordon off their villages and contributing to what could be the balkanization of southern Orange County outside Kiryas Joel.
Separate groups in Woodbury and Blooming Grove are circulating petitions to create villages, at least partly out of hope that having greater zoning control will keep the dense, multi-family housing of the Hasidim from spreading to their more rural or suburban areas.
But Hasids already own large, undeveloped land tracts outside of Kiryas Joel and are just as determined to develop it once the village is fully built out.
Property records show that Vaad Hakiryah alone owns at least 310 acres outside the village, including a 140-acre farm it secretly bought in January – much to the distress of Kiryas Joel's non-Hasidic neighbors.
Woodbury Supervisor Sheila Conroy said Friday that she hadn't heard about the latest village plans, but doesn't want the town to lose land or have dense housing built in places now zoned for large lots.
"Clearly, we'll follow what the law says," Conroy said. "But we feel we have very good and mixed zoning in our town. We hope somebody isn't planning to form a village just to gut our zoning.
"It's like a hostile takeover," she added. "In the corporate world, that's what it's called. We will seek our attorney's advice to do what's in the best interests of Woodbury."
The latest village proposal echoes the zoning battles that led in 1977 to the incorporation of Kiryas Joel, named for the late Satmar grand rebbe, Joel Teitelbaum. The village was expanded in 1983 to its current size of 691 acres.
The Kiryas Joel official said that while no boundaries for the proposed Kiryas V'Yoel Moshe – which includes the first name of the current grand rebbe, Moses Teitelbaum – have been drawn, organizers believe it could take up 600 to 1,000 acres in Monroe, Woodbury and, possibly, Blooming Grove.
Just four months ago, Vaad Hakiryah was said to be coordinating an effort to bring Hasidic-owned property in Monroe and Woodbury into Kiryas Joel through annexation – a more complicated process that could result in a court battle if the town losing the property resists.
But plans have changed, the village official said, because of the highly charged atmosphere surrounding Kiryas Joel's growth and proposed 13-mile pipeline tapping New York City's Catskill Aqueduct.
In particular, the climactic vote July 1 by the Orange County Legislature to formally oppose the water project convinced community leaders that no town boards would fairly review a petition to annex land into Kiryas Joel, he said.
The incorporation plan has replaced the annexation plan, he said, because it requires no town approvals – only the assent of the people living within the area of the proposed village.
With roughly 150 Hasidic families living in town areas outside of Kiryas Joel, plus others with summer homes there, organizers expect to reach the 500-person minimum needed to form a village, the official said.
What will happen if the proposal for Kiryas V'Yoel Moshe overlaps with the villages under consideration in southern Blooming Grove and Woodbury remains to be seen.
Although the Hasidim have repeatedly approached non-Hasidic homeowners outside of Kiryas Joel to buy their homes, some holdouts could soon find they live inside the boundaries of a proposed Hasidic village.
Patty Culver, who has lived outside of Kiryas Joel in Woodbury for 20 years and dreads the encroachment of its dense housing development, expressed anger and dismay at that prospect Friday.
"I don't understand why our politicians can't help us. Because they have a bigger vote?" Culver said, referring to Kiryas Joel.
"I don't mind them being there. But why do they have to do this?"

To annex or incorporate?
For land to be annexed into Kiryas Joel, a developer would have to petition the governing bodies of Kiryas Joel and whatever towns are being asked to cede the property – Monroe, Woodbury and, possibly, Blooming Grove. If Kiryas Joel approved the petition and any towns resisted, the developer could take the matter to the Appellate Division of state Supreme Court for a ruling. Experts say that in such conflicts, the courts tend to side with whatever municipality is better equipped to provide water, sewers and other services to the disputed territory – which, in this case, would likely be Kiryas Joel.
Several months ago, Vaad Hakiryah, Kiryas Joel's development arm, was said to be coordinating a massive annexation request that would bundle its own holdings with those of other Hasidic property owners in areas surrounding Kiryas Joel. But that plan appears to have been shelved in lieu of an alternative requiring no Town Board votes: the incorporation of a new village outside Kiryas Joel. With this approach, voters living inside the borders of the proposed village would decide the outcome.

KJ residents plan to build second village

Kiryas Joel – Besieged by critics hoping to stop its proposed water pipeline and eventual expansion, this fast-growing Hasidic community is quickly developing plans to incorporate a second village outside its borders to safeguard its future.
Vaad Hakiryah, a major landholding company that acts as Kiryas Joel's development arm, is leading an effort to form a municipality that could equal or exceed the size of the existing, 1.1-square-mile village, according to a Kiryas Joel official who spoke on condition of anonymity.

Myriad of deals done to carve out new village

By Chris McKenna
Times Herald-Record
cmckenna@th-record.com

Kiryas Joel – In January, when one of the last farms in Monroe and Woodbury quietly changed hands in two quick deals, a mysterious organization from Kiryas Joel with $12.7 million at its disposal wound up with the 140-acre prize.
Less than two months later, when news broke of a plan to annex the newly bought ACE Farm and hundreds more acres into Kiryas Joel, the same entity was said to be coordinating the effort.
That entity is Vaad Hakiryah of Kiryas Joel Inc., an organization tied to the Satmar Hasidic community's main synagogue – Congregation Yetev Lev D'Satmar – and led by a former village official named Mayer Hirsch.
For at least 12 years, it has held much of Kiryas Joel's vacant land and acted as its invisible hand of development, parceling out precious acres to builders erecting multi-family housing to keep pace with the rapid population growth.
Until recently, Vaad Hakiryah was known only in the insular and divided world of the Satmar Hasidim, where dissidents have long complained that it controls Kiryas Joel's housing market and improperly bridges church and state realms – charges that village officials steadfastly deny.
But with the ACE Farm purchase and annexation plan, Vaad Hakiryah – which now owns at least 310 undeveloped acres outside of Kiryas Joel in Monroe and Woodbury – has stepped into the increasingly heated politics surrounding the development of one of New York's youngest and fastest-growing communities.
Its role could soon become even more prominent – and the atmosphere hotter.
A Kiryas Joel official, speaking on condition of anonymity, revealed late last week that Vaad Hakiryah has shelved the annexation plan and instead will seek to incorporate a second Hasidic village – an alternative that could prove faster than annexation, while bypassing opposition from the leaders of neighboring towns.
Vaad Hakiryah means roughly "the committee of the settlement" in Yiddish, the primary language in Kiryas Joel. When it formed, who created it and how it came to possess so much of Kiryas Joel's vacant land is a matter of dispute, like so much else in the village.
Public records indicate it officially came into being in October 1989, when it was incorporated with Hirsch – then a village trustee – as its leader. The following July, four paper corporations were created to hold and transfer its land.
Two years later, on a single day in October 1992, 32 parcels totaling 153 acres passed into its hands. The inherited land made up 22 percent of the village's meager 1.1 square miles.
The reason for the transfer is unclear. William Goldenberg, a 68-year-old Kiryas Joel resident who appears to have signed the deeds shifting ownership from five paper corporations to the four controlled by Vaad Hakiryah, didn't return numerous phone calls for comment.
Over the years, Vaad Hakiryah has carved up its land and distributed much of it among developers, the village government, the United Talmudical Academy of Kiryas Joel Inc. – the religious school system used by most children in the community – and other entities.
Records of those transactions suggest that Vaad Hakiryah has at times used its valuable land to help the UTA raise money.
For example, while dicing and distributing a 79-acre chunk of land off Mountain Road – where most of Kiryas Joel's new development is taking place – it gave or sold the UTA 65 acres. The school system later sold the land to developers for $11.2 million. (See sidebar, "Carving the pie.")
Dissidents have repeatedly charged in federal lawsuits against the village that Vaad Hakiryah operates in a blurred nexus of government and synagogue leadership in Kiryas Joel.
Michael Sussman, a Goshen-based civil rights lawyer who has represented the dissidents, charged in a 1997 complaint that the organization was merely an association of congregation members and village officials and "the vehicle by which impermissible entanglement between government and religion is effected."
The charge was based partly on the revelation that Moses Teitelbaum, the Satmar grand rebbe, had decreed in May 1989 that builders must pay the UTA $10,000 for every new apartment and that Vaad Hakiryah would collect the money. The payments were said to pay for the new school space needed to accommodate the added population.
The dissidents implied that the village wouldn't issue building permits – a municipal function – until a religious school system had been paid. But they submitted no evidence linking the payments to building permits, and village officials denied any such link existed.
"No such monies have ever been received during my tenure as village clerk," Gedalye Szegedin replied in a court statement.
He said he was "unaware of any instance in which a developer was denied a building permit or other municipal approvals by the village because of this alleged $10,000 payment."
Dissidents supported their argument by pointing to the overlapping leadership of Vaad Hakiryah, the congregation and village government.
For instance, Kiryas Joel Mayor Abraham Wieder, a municipal official since 1984 and a former Congregation Yetev Lev president, signed public documents as the president of Vaad Hakiryah at least three times in 1990 and 1991, while he was deputy mayor. Copies of those papers were filed in court as evidence in connection with a 1995 dissident lawsuit.
Another link was Hirsch, a village trustee from 1982 to 1990 and chairman of the planning and zoning boards from 1990 to 1997 – while he was also the leader of Vaad Hakiryah.
During the 1990s, while running Vaad Hakirayh, Hirsch also was chairman of the Kiryas Joel Municipal Local Development Corp., a quasi-governmental agency whose building projects included the village medical center, completed in 1999.
Today, Hirsch, 54, serves on no village boards but is vice chairman of the development corporation. Both he and Wieder, in addition to their other roles, are trustees of the UTA school system.
Hirsch declined to comment for this story, referring all questions to his lawyer. Wieder, 55, also wouldn't discuss Vaad Hakiryah.
"The Vaad is neither part of, nor affiliated with the Village of Kiryas Joel," Hirsch's lawyer, Dennis Lynch of Nyack, wrote in response to written questions.
Refusing to discuss any of the organization's business dealings, Lynch also wrote: "The Vaad as a private for-profit entity is not required to disclose confidential commercial business matters including what properties it manages, if any."
Here's one property Vaad Hakiryah now manages: ACE Farm.
Earlier this year, word leaked out that the beloved, family-owned institution where locals have bought fresh eggs and other produce for years, had finally been sold to a developer – as neighbors long feared.
The buyer at first appeared to be a businessman from Corinth, who wanted to open some sort of recycling operation. But Ralph Petruzzo turned out to be merely a front man: He had actually flipped the Etzel family's land within days for a $1 million profit to Vaad Hakiryah.
For neighbors, the news conjured unpleasant images of more dense housing spreading across the 140 acres of fields bordering Kiryas Joel.
They got another shock in March, when it turned out plans had already emerged to try to annex ACE Farm and other Hasidic-owned property into Kiryas Joel from neighboring Monroe and Woodbury.
The Hasidic property owners had received a proposed contract, written in Hebrew, saying that Vaad Hakiryah would bundle their property with its own in a single annexation request.
In return, the landowners would have to pay $12 for every square foot of apartment space that could be built on their land – a charge that would pour millions of dollars into Vaad Hakiryah's coffers.
The proposal justified the charge by saying the organization had spent "tens of millions of dollars" on the community – to build roads, water and sewer lines, synagogues, ritual baths, the medical center, the shopping center and more – and would spend millions more in the future.
It's impossible to determine the extent to which those claims are true.
Lynch would say only that Vaad Hakiryah, like any other developer, has paid for "water, sewer lines, roads and other infrastructure" and then turned over the finished products to "the municipality having appropriate jurisdiction" – in this case, Kiryas Joel.
But he also distanced Vaad Hakiryah from any claims made in the proposal, saying it was written by a planner named Simon Gelb and has not been approved by Hirsch or his organization. Gelb, 33, who lives in Kiryas Joel, didn't return calls seeking comment.
A citizens' group called the Southern Orange County Alliance has since sprung up to oppose any future annexation request, as well as Kiryas Joel's plan to tap into New York City's water supply to meet its constantly rising demand – seen by opponents as the engine for more explosive growth.
But it now appears there may be no annexation request to resist. Instead, the Alliance might soon encounter a new target: a proposed village called Kiryas V'Yoel Moshe.

Carving the pie
Here is how Vaad Hakiryah, Kiryas Joel's invisible hand of development, has carved up and distributed a 79.5-acre chunk of land it inherited in October 1992 from several paper corporations.
Mazel Properties of Brooklyn bought the land from a Montgomery woman in January 1979, when it was an undeveloped tract in Monroe bordering the 2-year-old Village of Kiryas Joel. Kiryas Joel annexed the property in 1983 and dubbed it Section 307 on tax maps.
The property has since been subdivided numerous times and distributed, mostly to developers. Almost 65 acres passed first through the hands of the United Talmudical Academy of Kiryas Joel Inc., the village's religious school system. Property records show the UTA sold its share of the land in 1995 to developers for $11.2 million. Within the past five years, 222 condominiums and apartments have been built and occupied, 207 are nearing completion, and at least 318 are planned – a total of 747 homes.

1. 207 condos nearing completion and 126 more planned on 36.7 acres. Includes property the UTA sold to Kiryas Joel builder Abraham Goldberger on March 25, 2003, for $6.7 million.
2. 48 condos on 2.3 acres. Part of land UTA sold to Kiryas Joel developer Jacob Sofer on Feb. 20, 2003, for $1.2 million.
3. 48 apartments and grocery store on 5.4 acres. UTA sold the land to Shamrock Affordable Housing on April 29, 1999, for $481,000.
4. 102 condos on 7 acres, partly vacant. UTA sold Sofer the land on Jan. 26, 2001, for $1.6 million. (Six condos built by GPN Construction, which bought less than an acre from Sofer on Nov. 19, 2002 for $600,000.)
5. 24 condos on 1.3 acres. Part of land UTA sold Sofer on Feb. 20, 2003, for $1.2 million.
6. Partly cleared for construction of 192 proposed condos on 11.5 acres. Vaad Hakiryah sold Sofer the land on June 19, 2003, for $1.38 million.
7. Municipal water tank, Village of Kiryas Joel.
8. Vacant home on 5.2 acres, owned by Solomon Berkowitz.
9. Two municipal building projects on 4.4 acres. A new fire station – which will have a workforce development center on the second floor – opened this year. Behind the fire station, construction has started on a convalescence center for mothers. The village sold the land to the Kiryas Joel Municipal Local Development Corp. on Nov. 11, 2003, for $387,000.

Making a new village

By Maureen Nandini Mitra
Times Herald-Record
mmitra@th-record.com

Welcome to the balkanization of southern Orange County, where speculation, tension and rumors are rife these days.
Petitions to incorporate as villages are circulating in south Blooming Grove and Woodbury.
Simultaneously, the Hasidim, whom the residents of these towns are trying to keep out, have plans afoot to create another village near Kiryas Joel.
While the clash between two cultures has people on both sides scrambling for legal protections, there's little information on the streets about what creating another tier of local government would mean and how that could help maintain a way of life that each of these groups is trying to preserve.
Here are some common questions about creating new villages:

Why create a village?
Since 1940, there have been 25 villages created in New York.
In recent years, the most commonly cited reason for seeking incorporation is the desire to control or limit development, principally by getting more localized control over zoning. That is what residents spearheading the moves in Blooming Grove and Woodbury are hoping to achieve. The idea is to put in place zoning laws that would prevent high-density housing that Kiryas Joel prefers and also block possible annexation moves by the Hasidic village.
The youngest village in New York is East Nassau in Rensselaer County, which was incorporated in 1998 to keep a quarry from setting up shop in the area.
The village has a population of more than 500 and an annual budget of $108,000.

How is a village formed?
To be incorporated as a village, a petition signed by 20 percent of the qualified voters in the area, or by owners of 50 percent of assessed value of the area in question, has to be submitted to the town supervisor, who then schedules a public hearing.
The area to be incorporated shouldn't exceed 5 square miles and should have a population of at least 500.
Following the hearing, the supervisor makes a written determination of the sufficiency of the petition. Once the petition is approved, an election is held within the proposed village area.
If the proposal gets a majority vote, a new village can be formed. It does not require approval of other governing bodies at the state or local levels.

Can creating a village stop annexation?
Technically, no. A village can annex land from another village. Creating one could, however, have a substantial impact in letting a petition to request annexation move forward, says Eamon Moynihan, spokesman for the New York Department of State.
In order to have an annexation petition go through, 20 percent of the village population eligible to vote, or people who own 50 percent of the assessed value of the area in question, have to agree to be annexed.
Obviously, in a village where most residents want to keep the Hasids out, such a move can be blocked, or at least delayed substantially, says SUNY New Paltz political scientist Gerry Benjamin.

Could incorporation as a village lead to lawsuits?
Yes. For example, in 1991, when the Village of Airmont incorporated in Rockland County and enforced strict zoning that kept out a growing Hasidic population, it was sued by the federal government and some Hasidic groups, who accused the village founders of trying to zone out Hasids. The village was forced to change its zoning.
But, says Benjamin, even this can work in favor of a village.
The petitioners would find themselves caught up in legal wrangling with the village government, which could be time-consuming and expensive, he said. That might persuade them to look for land elsewhere.
The village, on the other hand, could mobilize its resources to hire a lawyer to fight the lawsuit – an expense a volunteer group, such as the South Blooming Grove Homeowners' Association, could ill afford.

What are the drawbacks?
Another level of government. More taxes. More red tape.
"Generally it's a bad idea, no matter how you slice it," says Mike DiTullo, president of Mid-Hudson Pattern for Progress, a non-partisan public policy think tank.
There are too many local governments in New York, he said. "If you add up the cost of the county government and the cost of 40 municipalities in Orange County, it comes up to over $1 billion. That's why our taxes are so high."
DiTullo brushed aside concerns about growth. "Orange County is growing at a rate of 1 percent a year. It's not an explosion, by any means."
Benjamin, however, thought concerns about density and rate of growth were "genuine."
But, he said, "a government should be formed for affirmative reasons rather than defensive.

Southern Orange County summit set for today

By Chris McKenna
Times Herald-Record
cmckenna@th-record.com

Goshen – Top elected officials in an area swirling with controversy have been summoned to the Orange County Government Center today to meet behind closed doors with Orange County Executive Edward Diana.
Diana called the meeting Tuesday, saying in a brief letter to the mayors and supervisors that he wanted the group to "address many of the issues that are affecting the future of southern Orange County."
He didn't elaborate, and didn't respond to a request yesterday to explain what he hopes to accomplish by assembling the leaders.
Tension and anger have reached a fevered pitch in recent weeks, all generated by Kiryas Joel's plan for a pipeline to tap New York City's water supply and the prospect that the fast-growing, urbanized community of Satmar Hasidic Jews will expand outward into greener surroundings.
Three neighboring municipalities and the Orange County Legislature have passed resolutions opposing the water project. And three groups, including one from Kiryas Joel, are now talking about staking out new villages in Monroe, Woodbury and Blooming Grove to protect their interests.
Kiryas Joel Mayor Abraham Wieder said he plans to attend today's meeting and hopes to find common ground.
"I'm willing to go with an open mind, but so should they be willing to go with an open mind to listen," he said.
Blooming Grove Supervisor Charles Bohan also said he'll attend, but then he vented outrage at Kiryas Joel over apparent plans by a group there to incorporate a second Hasidic village just outside the first.
Bohan called the proposal – reported in The Sunday Record – a bluff, told to the newspaper by Kiryas Joel just to scare the neighbors.
"They can take their big bluffs to the toilet with them," Bohan said. "The best thing that they could do for themselves is pack up and go somewhere else."
Kiryas Joel stirred the water a bit more yesterday with a letter to Woodbury Supervisor Sheila Conroy, announcing plans to drill new municipal wells on five properties in Woodbury. The letter mentioned Woodbury and the county Legislature's pipeline opposition and seemed to send a message that stopping the project won't stop Kiryas Joel from growing – only force it to draw more of the area's limited ground water.
Conroy wouldn't comment, but Orange County Legislator Roxanne Donnery, D-Highland Falls – a leading pipeline opponent – expressed outrage at what she called an intimidation tactic.
"They're doing this to get everyone off them on the pipeline," she said. "They need the pipeline to expand. I think the intention is to grow any way they can, no matter what it does to the surrounding community."
Kiryas Joel Administrator Gedalye Szegedin, who wrote the letter, replied that the Woodbury wells have been planned since 2002 – long before the pipeline controversy erupted – and voiced dismay at Donnery's objections.
"Stop the pipeline, stop the wells," he said. "What are we going to drink? Alcohol? Schnapps

Diana meets with county leaders today

Goshen – Leaders of seven southern Orange County communities met with County Executive Edward Diana this afternoon to discuss issues that have been roiling the region.
Diana said after the two-hour, closed-door meeting that no specific proposals had been made to resolve conflicts centered around the Village of Kiryas Joel. But he felt that initiating a dialogue among community leaders was an important first step.
"I think it was a very productive meeting," Diana said. He promised to follow up by speaking to officials individually and to encourage further meetings. "We believe we should have continued dialogue," he said.
Officials from Monroe, Woodbury, Blooming Grove and four villages, Kiryas Joel, Harriman, Monroe and Washingtonville, attended the meeting at the Government Center.
Tensions have been running high over Kiryas Joel's plans to build a pipeline to tap New York City's water supply and proposals to annex land from neighboring communties. Further, three plans have emerged to create new villages in southern Orange County: one in South Blooming Grove, one that would take up much of the Town of Woodbury and one that would take in outlying areas of Kiryas Joel and create a new Hasidic community.

Leaders open communication on issues vexing southern Orange

By Chris McKenna
Times Herald-Record
cmckenna@th-record.com

Goshen – Municipal leaders from strife-ridden southern Orange County talked in one room for two hours yesterday in what County Executive Edward Diana called an important first step in a continuing dialogue.
But no specific solutions emerged, and one key participant, Blooming Grove Supervisor Charles Bohan, left Diana's office half an hour before the others, apparently dissatisfied.
"It's a disgrace," he said as he walked out.
He declined to talk about the meeting.
Diana said he assembled the mayors and supervisors from seven municipalities to spur a discussion and try to lower tension in the region, beset with controversy lately over Kiryas Joel's proposed water pipeline and potential expansion.
In a news conference after the closed session, Diana said the discussion touched on a wide range of issues – both the Kiryas Joel ones that have raised tempers lately and others that have long vexed Woodbury officials, such as traffic on Route 32.
He called the session productive – and mostly civil – and promised to follow up by talking to the officials individually and asking them to meet again.
"We believe we should have continued dialogue," Diana said.
On the question of Kiryas Joel's proposal to tap New York City's water supply, a project that has set off fierce opposition, Diana repeated his position that the county, rather than a single village, should be taking the lead and that the tap should serve a whole region.
"I believe if this project goes forward, it should be a countywide project," Diana said.
He also said he opposed incorporating new villages in southern Orange County, as three groups have talked about doing recently as the battles over Kiryas Joel's growth have grown.
"I have always believed there should be less government, not more government," Diana said.
The meeting brought together representatives from the towns of Monroe, Woodbury and Blooming Grove and the villages of Kiryas Joel, Monroe, Harriman and Washingtonville.
The participants dispersed while Diana spoke to reporters afterward, and most couldn't be reached for comment later.
Kiryas Joel Administrator Gedalye Szegedin said: "Leaders should have communication lines open all the time, and we appreciate the county executive taking the initiative. Kiryas Joel is always willing to communicate and understand the needs of its neighbors on any of these important issues."

Woodbury
Aug. 5 Public hearing on Woodbury village

There were few comments about the proposal to incorporate a village of Woodbury at last night's Town Board meeting.
The subject was overshadowed by talk of the next step in the fight against Kiryas Joel's proposed pipeline tapping into New York City's water supply, and the Hasidic village's recent plan to drill wells in Woodbury.
Get people in the city involved in the pipeline issue, urged county Legislators Roxanne Donnery and Frank Fornario, and members of the Southern Orange County Alliance, a grass-roots group fighting the pipeline.
Supervisor Sheila Conroy said as far as the wells were concerned, she didn't care for the "psychological warfare" being waged by Kiryas Joel. "We will do everything in our power to preserve the character and zoning of Woodbury," she said.
The Town Board scheduled an Aug. 5 public hearing to discuss the validity of a petition to incorporate as a village that residents submitted to Conroy on Monday.

Southern Orange County summit

Diana: "... we have
enough governments"
Orange County Executive Edward Diana spent two hours behind closed doors yesterday with town and village officials from southern Orange County to begin a dialogue concerning several contentious issues that have caused a rift among some communities in that area of the county.

They talked about the Southeastern Orange County Traffic Task Force, the New York City aqueduct and proposed pipeline from New Windsor, annexation in southern Orange, sales tax collection, Woodbury Common traffic, the future of Metro-North parking and a new train station, and general growth issues.

While there were no concrete decisions coming from the session, Diana told reporters afterwards that he has an opinion on one subject, that on the possibility of a second village like Kiryas Joel in that area of the county.

''I have always believed there should be less government, not more government anywhere, and certainly when I look at the potential of other villages sprouting up in Orange County, I would be opposed to that,'' he said. ''I think we have enough governments, enough municipalities, 40 in number today, so I wouldn't encourage that.''

Diana said the meeting was cordial, although there were some instances of raised voices.

He plans on holding other such sessions to continue the discussions about the key issues

Seeking calm on KJ pipeline
Orange County Executive Edward Diana has taken a proper leadership role in trying to forge a solution.

Orange County Executive Edward Diana stepped into a political hornet's nest last week when he convened a meeting of municipal leaders from southern Orange County, which lately, with all the talk about creating new villages, has seemed more like the Balkans.
It was a display of much-needed leadership on Diana's part and one that should continue even after tempers cool, which one sincerely hopes they do.
The catalyst for the meeting was the hostile debate in that part of the county over a proposal by the Village of Kiryas Joel to tap into the New York City aqueduct. That search for water has escalated into heated arguments over the village's growth and its impact on neighboring communities. It has also degenerated into some stereotyping and criticism of residents of the Hasidic village for who they are rather than what they seek to do.
When the debate rushed past thinly veiled bias towards KJ to talk (on both sides) of creating new villages to thwart opposing viewpoints, things were clearly threatening to careen out of control. A meeting of the minds – even closed ones – was needed.
Diana invited elected officials from the villages of Kiryas Joel, Washingtonville, Harriman and Monroe and the towns of Monroe, Woodbury and Blooming Grove to the mini-summit. All the municipalities attended, which is a good way to start.
The executive made two key points following the meeting:
- Orange County does not need more levels of government. Residents of Blooming Grove and Woodbury, who are talking about forming villages to thwart Kiryas Joel's growth, are needlessly complicating matters and adding more fuel to the fire. The same goes for Kiryas Joel residents who are contemplating a second village bordering KJ to accommodate future growth.
Diana's right. It's hard enough to get cooperation in New York with its home rule laws and multiple layers of government without tossing three more elected bodies into the mix.
- The county should take the lead on tapping into the New York water source, if that's what's needed, so that the pipeline serves the entire region. New York officials have said they wouldn't sell water to KJ if it planned to allow neighboring communities to tap into the supply, even in emergency situations. However shortsighted that policy may be, it would seem that a bid by Orange County to get access to the aqueduct would avoid it.
So by all means, Diana should get his planning department and Water Authority on the case. With all the expertise and resources the county can bring to the process, compared to any one municipality, it should be able to devise a regional solution to the perennial water problems in southern Orange.
But we would point out that this is far from a new issue and in trying to tap into the city water supply, Kiryas Joel was only doing what any other government body in the area could have done, but didn't.
Diana plans more talks, individually and as a group, and they will include other topics, such as traffic and transportation. This is an encouraging and appropriate role for county government. We also would hope that the next time this group meets, it will be in public since the participants are discussing issues affecting all county residents.

KJ pipeline could be key to area's water ills

By Pincus Jakobowitz

The Kiryas Joel Alliance is a union of independent Kiryas Joel citizens and is not associated with the village government. The Kiryas Joel Alliance believes that as a people we ought to live in peace with our neighbors. We also believe that every effort be made so that our unique growth pattern shall have little impact on our neighbors.
Self-sufficiency has been a common element with residential developments among many local planning boards, in alleviating concerns that "excessive" growth would overwhelm existing town infrastructure. The more this community grows, the more self-containment provisions it ought to implement for the consideration of its neighbors; a pipeline would do just that. The people of our neighboring municipalities choose to live in a countryside environment and desire to preserve that character of their communities; these wishes should be and indeed are appreciated and respected.
Now on the other hand, if the people of Kiryas Joel by their beliefs live in a way that brings about increased density and urban or suburban environment within their community, that may be better respected when a sincere conscience exists to self-contain the consequences of their way of living to their own community. Accordingly, the very problem here is not "growth," it is the "impact," and a pipeline would address just that.
Self-sufficiency or self-containment is key to sustainable growth and is precisely what needs to be done if we are to achieve our desire to lessen impact on our neighbors to its minimum. The people of Kiryas Joel, by their customs, beliefs and way of life, do have a high growth rate. This growth rate is not self-created by strategically or premeditatedly bringing in more and more people to relocate into this village; no, it is simply created by the mere practice of everyday life the way we believe in. Hence, if growth will continue, it will continue with a pipeline or without, whether it means receiving tanker trucks every Friday or every day.
However, the problem is not merely growth, it is also the impact such growth would have on our neighbors; the problem is overburdening resources; and the problem also is the need to be responding to an approaching human crisis, and this all is exactly what a pipeline would remedy.
Furthermore, the Kiryas Joel Alliance indeed supports a regional solution and believes that the installation of this 13-mile pipeline should be the groundwork for that. New York City's water supply is available to all of us by statutory right; however, it is the "access" to this available water supply that southern Orange County does not have yet. With a project that will provide for that "access," the issue is not the sharing of water, but the sharing of water transit facilities; namely, the pipeline.
The state of New York's Water Supply Act of 1905 authorizes every municipality that is situated in a county through which the city's aqueducts transverse, to take their water supply from the city's water system, as of right. More than 75 municipalities throughout upstate New York – including the City of Newburgh, Town of New Windsor and Cornwall-on-Hudson – are taking advantage of this statutory right.
However, despite proposals from former and current county administrations, a regional water pipeline has not yet been constructed to address the water issue for southern Orange County, thus, the means for tapping into the Catskill Aqueduct simply does not exist. If the Village of Kiryas Joel is now willing to undergo the pain that it takes to implement this long-awaited but complex and costly project, and among others obtain a federal grant in the amount of $20 million that will cover more then two-thirds of the project's total cost, it is worthy of being received with hope and anticipation.
With the water transit infrastructure in place, the opportunity should now be open to neighboring municipalities to apply to the City of New York for their share of water under the Water Supply Act of 1905.
The Kiryas Joel Alliance commiserates with those concerned about the inconveniences a pipeline project may cause during the interim construction period, and trusts that these people will understand that we are sharing issues that only together we can work on effectively, for the mutual welfare of our communities. The Kiryas Joel Alliance, while it does not posses official negotiating power on the issue, does extend its invitation to concerned parties to listen to their concerns and discuss the issue in a collaborative spirit.
The Kiryas Joel Alliance would like to make it very clear that this letter is the first and hitherto the only public opinion made by the Alliance on the issue in question, and other than this letter, we did not partake in the subject debate in any way. This letter should not be construed as an endorsement or confirmation to any statements voiced by either side of the debate. Furthermore, the Kiryas Joel Alliance has not seen the data pertaining to the current and projected capacity of Kiryas Joel's present ground water supply system or the viability of alternative solutions if any.
The Kiryas Joel Alliance is hopeful for an epoch of good neighbor-ship and mutual collaboration for the good of us all.

An open letter to our neighbors in Kiryas Joel

By Beth Quinn
Times Herald-Record
bquinn@th-record.com

You guys need to have a block party and invite the neighbors.
Really.
Because we have a situation here. We've got people in Orange County saying "those people" when they talk about you. Or "parasites." And we've got your village leaders accusing folks of being anti-Semitic, anti-Hassidic and kind of like Hitler.
None of this is good, and it's only going to get worse unless you have a party and break some bread with your neighbors.
What a stupid idea, you might be thinking. Who'd come? I will tell you who'd come. I would.
Listen, you've been seeing some letters in our paper from people who don't seem to like you too much. But how do you think we got to this situation in the first place?
I'll tell you how – and people of Kiryas Joel, please keep an open mind here. We got to this point because, from the beginning, you never seemed to want anything to do with people outside your own community.
You say it's part of your culture not to mingle. You call it tradition. And I suppose there are passages in the Talmud that limit how you interact with others.
That's important to you, I understand. I know your men don't meet my eye out of respect for their own wives, not out of contempt for me. But you must understand that, from the perspective of your neighbors, that just comes off as plain rudeness.
We're talking about perception here.
Listen, I've gotten to know – a very little bit – a couple of your villagers. And I like them. We have e-mail exchanges. We argue political points, with respect and good humor. We each try to understand where the other is coming from, not always successfully, but always with a nod to each other's utter sincerity.
I don't know if I'd say we're pals, exactly, but it's two people getting to know each other. Meeting halfway.
The problem is, we don't have a lot of people getting to know each other around here. And that gets us entrenched in this "us versus them" business.
You might think we're all jerks. Sure, some of us are jerks. But you know those people writing letters to the editor, the ones calling you "those people"?
Well OK, I don't know them personally, either, but it's my bet that they're the kind of people who'd give the shirt off their backs to help a stranger.
I'll bet most of them think of themselves as open-minded, good-hearted people, and they probably are for the most part. But they don't know you, and they're scared. When people are scared, they say things.
And we might think you're all unfriendly. And I'd imagine some of you are unfriendly. But I know from experience there are friendly people in Kiryas Joel.
So what we've got going on here is stereotyping on both sides. No one's seeing individuals, and that's always dangerous. I fear for where we're heading.
So how did this all get started?
It's because there's never been a party.
We need to do some dancing. OK, OK, men dancing with men and women with women. That's cool. I'm not suggesting you hold a rave, just a bit of outdoor music so people can tap their feet on the street.
And food. We must have food. Perhaps you can call it a pot-luck supper. Everyone brings something. Hot dogs and burgers. Gefilte fish. Whatever. People pick what they want for their plates.
Very simple.
We'll listen to the music, we'll talk like neighbors. What's your name, where do you work, what a cute little girl you have. Just friendly interest.
Nobody's looking for a sleepover. Just some neighborliness.
Listen, I make a good macaroni salad. I'll bring a watermelon, too. My husband will dance. He's a good dancer and he doesn't care what gender his partner is.
Just no kissing. I get jealous.
Come on. Let's party. It's a whole lot better than what we're doing now, don't you think?

Beth Quinn's column appears on Monday. Talk to her at 346-3147 or at bquinn@th-record.com.

July 18, 2004 -- A year after the shooting death of City Councilman James Davis, his family is bitterly split over his legacy, with opposing sides trading accusations that the other is trying to exploit the politician's name for money and power.
Two brothers are behind dueling tributes on this Friday's anniversary of Davis' murder inside City Hall by would-be political rival, Othniel Askew.

One memorial is set for 6 to 8 p.m. at St. Mark's Episcopal Church in Brooklyn, with Mayor Bloomberg and other officials invited to speak.
]
The other memorial starts at 7 p.m. in the Rose Castle Ballroom in Brooklyn, featuring a couture fashion show, the Rev. Al Sharpton as keynote speaker and singer Melba Moore.

Court battle possible in KJ pipeline war

By Chris McKenna
Times Herald-Record
cmckenna@th-record.com

Goshen – Several Orange County lawmakers hoping to stop Kiryas Joel's proposed water pipeline have raised the possibility of taking court action to challenge how the village conducted the environmental review of its unpopular project.
Talks are preliminary but signal that legislators who persuaded their colleagues to pass a resolution condemning the project on July 1 now want to take action that could disrupt Kiryas Joel's plans.
"We're looking at all the avenues – anything and everything," said Legislator Frank Fornario, a Blooming Grove Republican who co-sponsored the pipeline resolution that was adopted by a 20-1 vote.
Kiryas Joel officials, who hope to start laying a 13-mile underground pipe to New York City's Catskill Aqueduct next year, clearly believe they met all the technical requirements of the state-mandated environmental review, which they concluded May 4 by adopting a final environmental impact statement.
As if to show legislators they had adhered to state law, village trustees listed steps they took in their environmental review in a recent resolution – their long, angry rebuttal to the county's opposition to the project.
But some county lawmakers – suddenly drawn into what has become a hugely controversial project – are taking a fresh look at the completed environmental review and questioning even one of the very first steps: the village's designation of itself as the "lead agency."
"We should have been the lead agency," Legislature Chairman Alan Seidman said yesterday, citing the project's potential impact on growth and development in the region and the amount of wastewater the county will have to treat.
Asked why the county didn't object when Kiryas Joel made itself the lead agency, Seidman says he never saw the notice.
"I'd like to see the distribution list," Seidman said. "I didn't get one."
Seidman also complained that because of when Kiryas Joel sent the county a draft of its environmental impact statement last year, officials from various departments had only three days to respond to a host of complicated issues.
Village officials couldn't be reached yesterday to respond to that charge.
Kiryas Joel Administrator Gedalye Szegedin said on Thursday that neither the county nor any other agencies – including Blooming Grove and Woodbury, two towns that passed resolutions opposing the pipeline – submitted written responses to the final environmental impact statement.
The county's failure to do so has just become a point of contention.
County Planning Commissioner David Church said yesterday that the county decided it could better address its concerns about its project when Kiryas Joel approached its health and public works departments for crucial permits.
But County Legislator Roxanne Donnery is chastising the administration for failing to put its concerns on the record.
"I am absolutely appalled that David was not told to put something in writing by the county executive," she said.
County Executive Edward Diana was away yesterday and couldn't be reached to respond.
Critics of the project are now poring over details of the review process, asking who was notified and when, to decide if they have enough grist to invalidate it, possibly through a lawsuit.
But they say they're exploring other options, too – whatever they can do to halt the project.
Donnery, a Highland Falls Democrat who sponsored the pipeline resolution with Fornario, vowed: "Frank and I are going to turn over every stone, legal or otherwise. We're not going to stop. We're doing our homework right now."
Officials say a deadline to challenge the environmental review is looming – perhaps on Sept. 10 – although it was unclear yesterday if that was the final date to file a lawsuit or seek an administrative remedy.

Letters to the editor for July 25, 2004

TH-R readers react to Doug and Beth on KJ

Last week, Times Herald-Record columnists Beth Quinn and Doug Cunnigham offered separate opinions on the controversy surrounding a proposal by the Village of Kiryas Joel to contruct a pipeline to tap into the New York City aqueduct. Some reader responses to their columns follow.
* * *
Beth Quinn's opinion that many of the people in Kiryas Joel are good people is accurate. The problem is not the people but the leadership of the village. The people don't even know what is going on, because they have no access to our newspapers, and they don't interact with us. They basically do what the leadership tells them to.
Doug Cunningham, who is obsessed with development and loves planning, good or bad, sees nothing wrong with what the leadership of Kiryas Joel is doing. However, he doesn't live nearby, and his property is in no danger. The problem with this village is not just the growth, but that it wants to grow over its neighbors.
As for 1938, none of us is building gas chambers; the barbed wire was put up by Kiryas Joel. Our problem is the leadership keeps moving that barbed wire outwards.
Valerie Hunter-Bequette
Middletown
* * *
If Mr. Cunningham suspects "there is some anti-Semitism at work" in regard to the KJ issue, then he should take a good look in the mirror. A quote from his recent op-ed: "Alternately, they should stay within Kiryas Joel, abandon all thoughts of growth or movement, and willingly accept the barbed wire the rest of us ever-so-tolerant citizens will string around the outside. November 1938, anyone?"
How dare he put such vile words into the mouths of other citizens to imply they are thinking this way. Many Jews whose relatives died at the hands of Nazis are now seething at Cunningham's implication that their opposition to Kiryas Joel's expansion might be based in anti-Semitism!
Cunningham's foolish assumptions feed the fires of prejudice itself. Focus on the issue: one community's explosive growth and its regional impacts on all communities and the environment.
Don Devine
Chester

This letter concerns the column written by Beth Quinn July 19 concerning "those" people residing in KJ.
Beth! I've always considered your exceptional writing talents and your sense of common sense a huge asset to the TH-R. But your suggestion to enhance relations between KJ and the surrounding community by throwing a block party is about as ridiculous as snow in August.
There are lifters and leaners in this world, and the leaners have been using the system. Under the guise of religious freedom and laws, and the lack of courage by certain politicians, the people in these surrounding communities have been used and abused.
So, Beth, I suggest you take your macaroni salad and watermelon, throw your own block party and invite "those" people. See how many show up.
John Candito
Highland Mills
* * *
Quinn nearly hits the nail on the head, while Cunningham exemplifies the problem. KJ has a serious public relations problem, and won't be able to make real progress until it admits and addresses that.
To attribute negative reactions to anti-Semitism is an easy way for KJ to resist looking at its own part in this drama, which is that KJ makes it clear as day that it does not consider itself part of the larger community. This is the fundamental insult that the rest of us will never be able to swallow.
We grew up learning that America is a melting pot, where all groups are welcome to work, play and communicate together. Acceptance is a two-way street.
I agree with Beth Quinn that there is still a chance. If KJ residents want to avoid a permanent state of antagonism, they will embrace and educate the community instead of defying it. Make Orange County grateful for your presence and your business.
It's quite possible. And for the rest of the community, let the wounds of the past be in the past, be friendly with your Hasidic neighbors, and vigilantly insist on legislative integrity at all levels. And if government support for large families is your complaint or fear, then contact your representatives.
Warren Sirota
Greenwood Lake
* * *
Regarding Doug Cunningham's column about not scapegoating KJ for planning, the problem is there is no family planning. Their culture is partly formulated on having as many children as possible. It's part of their religious beliefs and they are entitled to it.
The problem is, because of their religious beliefs, non-Hasidic peoples pick up the cost of having as many children as possible. I chose to have only two children because I couldn't afford more. Both my husband and I have worked all our lives and continue to do so.
Please correct me if I'm wrong, but isn't at least 80 percent of the Kiryas Joel population under some form or another of public assistance? I say live and let live, but if my tax dollars are supporting their cultural and religious beliefs in family planning, then there is something wrong here.
Yes, they need water, but where is their responsibility to the remainder of Orange County? If this sounds racist, I truly regret it because I don't consider myself a racist. There has to be a regional solution, not just a Kiryas Joel one. Any self-contained culture can't have it both ways.
We have to learn to live together, not push neighbors away until you need them. This breeds mistrust. We have to do better and that includes Kiryas Joel.
Lydia Negron
Washingtonville
* * *
Regarding Douglas Cunningham's column: He is correct that most people in Orange County should be jealous of the ability of KJ politicians to obtain grants and get others to pay for their lifestyle.
All other comments are from someone who most likely doesn't live near any of the communities that follow the laws followed by KJ. Let's disregard the cowardly anti-Semite label he throws out; that is just a way to remove some weaker people from debating.
We the people of Orange County have rights, too. We have the right to purchase a home within a residential area knowing that zoning will not be changed 10 years later. We have a right to expect our wells to be safe from poaching. We have a right to expect our tax dollars to be spread evenly throughout the county. These truths we hold to be self-evident.
Tom Bryceland
Harriman
* * *
I am Jewish, although the residents of Kiryas Joel would probably call me a goy (non-Jew) because I am not of their particular sect. I am glad not to be living near Monroe with "those people" as neighbors.
The problem is not anti-Semitism, although I don't doubt there is some of that going around. The problem is that the perception, and probably the truth, is that they are takers and not givers.
Beth Quinn's column of July 19 is a good start, but not a solution. Doug Cunningham made some good points in the same issue of the Record. But what is needed is for the KJ community to contribute to the whole community. To be fair. To be cordial. To be honest with those not in KJ.
Carl Silverstein
Monticello
* * *
I'm not sure if I'd go to Beth Quinn's party at Kiryas Joel, but I'd sure like to get one started up here in Sullivan County where things are starting to heat up as the Hasidic community spreads into the western towns. Every day it's, "Did you hear, they want to buy the campgrounds! They bought a building in Hortonville, in Youngsville, in Jeffersonville."
Well, who could blame "them" – it's really beautiful in this neck of the woods. It's just that people around here want neighobrs they know by name, not a collective group known as "those people." A smile, a simple greeting, a head nod – all go a long way, on both sides.
I had a lovely conversation with a Hasidic family in Home Depot yesterday – the first time that had happened in the 30 years I've lived here. I hope to have more.
Lisa Davies
Youngsville
* * *
In the beginning, Kiryas Joel didn't like Monroe's laws, so they incorporated. Now neighbors seeking more control of their own destiny are labeled Nazis?
The short version is KJ is growing so fast it's not unreasonable the local towns fear a loss of autonomy. This may already be too late. It's a great rallying cry for KJ that this village's rights are all-important, while at least half of KJ's residents are denied their rights on religious grounds. Add to this a move to stop payments to the Monroe town library with the rationale "Why should we contribute to something we don't use?" I'm at least a little outraged this town that receives so much public funding would have this complaint. Why is it anti-Semitic that outsiders should feel the same way about their tax money?
Then there's always the constitutionally challenged school district, with the state's highest per-student aid ratio. Don't paint me as someone who's against education, but it's bizarre the public only funds one "private" school – this one. I wonder why there's so much resentment in southern Orange.

But now that those two neighboring communities have passed resolutions opposing the proposed pipeline, Kiryas Joel assumes they no longer want access to the aqueduct water.

Kiryas Joel – Just how big this community's booming population might grow could come down to a meager 18 inches.
That's the diameter of the pipe Kiryas Joel hopes to snake 13 miles across Orange County to siphon off some of the water coursing toward New York City via the Catskill Aqueduct.
A few inches go a long way with water pipes. And in this case, 18 of them could carry enough water from the Catskills to Kiryas Joel faucets to support a population of at least 67,000 people – more than four times the village's current size, the Sunday Record has calculated with help from the Orange County Water Authority. Reaching that mark would give Kiryas Joel more than twice as many people as any Orange County municipality today.
It's no surprise that the leaders of Kiryas Joel – one of New York's fastest-growing municipalities – expect the village's numbers to keep climbing and would plan a pipe wide enough to supply future generations.
But until now, nobody involved in the escalating debate over the village's water project and population growth has offered any public projections of how many people the pipe could serve years from now if it was operating at full capacity.
Even a conservative estimate of 67,000 will likely rankle critics who feel the Hasidic community is growing too much and has failed to adequately explain the potential environmental consequences of its water project.
Even with Kiryas Joel's rapid growth rate – 5.9 percent a year between 1990 and 2000, according to the village's consultants – the day when its streets of mainly three-story apartment buildings would be home to 67,000 people might seem distant.
But multiply its estimated population of 14,904 in 2002 by 5.9 percent a year – year after year – and you find that Kiryas Joel would pass that threshold by 2029, just 25 years from now.
It's unclear if New York City would allow Kiryas Joel a pipe as wide as 18 inches – or even if the project will go forward as planned, considering the intense opposition it has aroused in Orange County and efforts under way to challenge and derail it.
Indeed, city officials expressed concerns about the pipe size several months ago, when Kiryas Joel was planning an even wider one of 24 inches.
In November, Paul Aggarwal, an engineering supervisor for the city's Department of Environmental Protection – the agency overseeing the vast underground tunnels that carry 1.35 billion gallons of water each day from upstate reservoirs to New York City – questioned at a public hearing why Kiryas Joel wanted a pipe width that can normally accommodate up to 12 million gallons a day.
In response, Kiryas Joel – which in 2002 needed only about one million gallons on average – cut the proposed pipe diameter by a quarter, to 18 inches.
The DEP, which is still reviewing Kiryas Joel's water application, has taken no position on the new size, agency spokesman Ian Michaels said.
"We're waiting for their engineering drawings to see what their alternative would be," he said.
Kiryas Joel Administrator Gedalye Szegedin said the village deliberately picked a pipe much bigger than what its current population needs because it doesn't want to have to dig up roads and replace the pipe if the line is no longer big enough.
See PIPEon page 34
Continued from page 4
Laying a 13-mile pipeline is too disruptive for too many neighbors to do twice, he said. The pipe would be buried under roads in four towns – Monroe, Blooming Grove, Cornwall and New Windsor – to tap the Catskill Aqueduct in the Vails Gate section of New Windsor.
"You want to do it once and for all," he said. "Nobody wants to rip out 13 miles of roadway."
Another factor, he said, was that the electrical bill for pumping water through an 18-inch pipe was less than what it would be for a narrower line.
If the project goes forward, Kiryas Joel could draw as much aqueduct water as its last census population and the average usage in New York City would justify – currently, 1.8 million gallons a day, far more than what it needs on most days.
But that limit could keep rising as its population climbs – if the pipe is wide enough to handle the additional flow.
In fact, Kiryas Joel wouldn't even have to ask: Michaels said that after each census, the DEP uses the new population figures to automatically update the withdrawal limits of each of the 65 or so upstate water systems connected to its aqueducts.
Szegedin resists the notion that the pipe diameter could determine Kiryas Joel's future size.
In his view, the village's population growth is virtually an immutable fact – the result of customs in which couples marry young, settle in the bride's home community and have lots of babies. He insists that pattern will hold true regardless of what happens with the pipeline.
"I don't think that the amount of growth in the community is at all contingent upon the pipe," Szegedin said.
But that argument rings false to Michael Edelstein, president of the environmental watchdog group Orange Environment Inc. He accuses Kiryas Joel of trying to "scam" the DEP by saying its growth is inevitable and denying the project will induce it.
"It's a semantic argument," he said. "You can't have people there if you don't have the resources to support their being there."
And the notion that the pipeline could carry as much as 9 million gallons of water underscores for Edelstein what he and some county officials feel is one of the plan's biggest oversights: its failure to explain how additional wastewater made possible by the project would be treated.
Village officials have written only brief responses to such concerns, simply saying that sewage treatment plants in Kiryas Joel and Harriman might be expanded to handle the gradually increasing flow.
Privately, they seethe at the criticism, saying Kiryas Joel already proved its seriousness on the issue – and bailed the county out of potentially costly lawsuits – by building its own sewer plant after the county's Harriman plant hit capacity.
But Edelstein, whose organization successfully sued the county in 1996 over excessive discharges from the Harriman plant, argues that Kiryas Joel's implied solution might be untenable because the Ramapo River can't handle any more sewage from that facility and the one in Kiryas Joel.
"In my view, we've finished with the Ramapo," he said, "and it's not appropriate to allow further growth until you find some other way to address the issue."
Another question is whether Kiryas Joel has enough room for 67,000 or more residents.
The village is only 1.1 square miles, and building homes at typical density on its remaining land – figures gleaned from the environmental review for the pipeline – could max out Kiryas Joel eight years from now, when the population clears 25,000.
That leaves the community the option of either replacing existing homes with high-rises or expanding its borders to make space for new apartments for all the newlyweds – currently, around 200 couples a year, the village estimates.
As people in neighboring areas are already acutely aware, the latter option could either involve annexing land from outside its borders or incorporating a second village – prospects that opponents are already taking steps to try to prevent.

Project cost
Kiryas Joel now estimates its connection to the Catskill Aqueduct could cost $22.2 million, a substantial drop from the $29 million it last calculated. What changed is that the village no longer plans to extend the pipe closer to Washingtonville than originally thought or install taps that Washingtonville and Blooming Grove could use to draw water on an emergency basis. Factoring in such modifications had raised the projected cost. But now that those two neighboring communities have passed resolutions opposing the proposed pipeline, Kiryas Joel assumes they no longer want access to the aqueduct water.
The village has asked Congress for $20 million to cover much of the cost. While that request is pending, trustees passed a resolution this month authorizing $22.2 million in bonds to pay for the project.

Crunching numbers
Jay Beaumont, executive director of the Orange County Water Authority, went through the following calculations to determine how much water Kiryas Joel's proposed pipeline could carry in one day if the diameter were 18 inches.
First, converting inches into feet and using the formula to calculate the area of a circle, you get a cross-sectional area for the pipe of 1.77 square feet. Then, multiply that number by the speed with which water generally moves through pipes. Beaumont said that rate, assuming average pumping power, is 8 feet per second. You now have 14.16 cubic feet per second.
The next task is to convert that figure into the customary unit for municipal water use: millions of gallons per day. A cubic foot holds 7.48 liquid gallons, and there are 86,400 seconds in a day. Multiply those two numbers by 14.16 and you get more than 9 million gallons of water per day. But to be conservative, cut that number in half to 4.5 million gallons a day, Beaumont advises. Water transmission lines, he says, are usually designed about twice as wide as necessary so they can handle demand surges, like fires.
Now, to determine how many people Kiryas Joel's pipeline could serve, consider that the average daily water demand in Kiryas Joel in 2002 was about 1 million gallons. The Census Bureau estimates the village's population that year was 14,904. That translates to an average daily water demand of 67 gallons per person. Therefore, a pipe capable of carrying 4.5 million gallons a day could comfortably serve more than 67,000 Kiryas Joel residents.
Kiryas Joel Administrator Gedalye Szegedin says the village's consultants calculate the pipe capacity slightly lower: 8 million gallons a day. They haven't estimated how many people that would serve, but 67,000 seems like a reasonable figure, Szegedin says.
