Another lawsuit seeks to shut down Kiryas Joel

(06/14/11) ORANGE COUNTY - Another lawsuit has been filed against leaders in the Orange County Hasidic community of Kiryas Joel in hopes of shutting the village down due to alleged corruption.

The lawsuit is between two Hasidic groups who are divided by synagogues. The Yetev Lev temple is the village's main congregation and is being sued by a minority group called the Dissidents, who pray somewhere else.

The 59-page federal lawsuit was filed on behalf of Joseph Waldman, alleging widespread misconduct, discrimination and terrorism.

David Ekstein, the president of the Yetev Lev Congregation, has denied the allegations, claiming that the Dissidents are making it all up

KJ dissidents defend grievance

Village leaders claim lawsuit has 'no merit'

Conflicts continue to brew between two factions in the Village of Kiryas Joel, leading to a federal lawsuit announced Monday. In a previous skirmish between the two Kiryas Joel groups, the majority faction sent a backhoe to demolish part of the area in front of the dissidents' shul in October 2009. Dissidents prevented it that day, but demolition resumed the following June.Times Herald-Record/TOM BUSHEY

After collecting grievances for years, Kiryas Joel dissidents say the conflict that drove them to federal court on Monday to seek a drastic remedy was the closure of a synagogue in which one of their groups had prayed for years.

After losing their fight in state court to keep open their shul, and then failing to get Kiryas Joel's authorities to let them reopen it, the dissidents added that chain of events to a court complaint alleging pervasive discrimination against them by the village's ruling faction — and asking that the municipality be dissolved after 34 years in existence.

As longtime dissident Joseph Waldman explained at a news conference announcing the lawsuit Monday, people in the minority faction were willing to be passed over for municipal jobs and to be taxed differently, but they couldn't accept the closure of a synagogue.

"One thing that every Jew will give his life for is to have a place to do his prayers," Waldman said.

Dispute began with apartment

Village leaders responded to the lawsuit on Tuesday with a statement saying "a small group of discontented persons" was using the case to try to undo the will of voters, since their political candidates have lost in municipal elections.

The leaders claim the case has "no merit."

"The discontents filed a similar lawsuit some dozen years ago," the statement reads. "That lawsuit was dismissed, and the rejection upheld by the federal Second Court of Appeals."

Kiryas Joel leaders also boasted of the wide-ranging municipal services they provide for "over 21,000 souls" and denied any discrimination in delivering them.

"The services-oriented policies of the elected government have benefitted all residents of the Village and indeed have benefitted the greater community," they wrote.

The synagogue dispute that motivated the new lawsuit involves a former apartment built in the 1970s for Satmar founder Joel Teitelbaum on the back of the building where Kiryas Joel's main congregation worships.

A dissident group later inherited the space from Teitelbaum's widow and converted it into a house of prayer.

The group, known as Congregation Bais Yoel Ohel Feige, vacated the building under court order in December 2009, having been told it needed approval for the new use.

The group has since sought permission to reopen the synagogue, without success.

Similarities to previous case

A series of skirmishes took place before and after the dissidents left their shul.

In October 2009, they stopped a construction vehicle sent by the majority faction as it ripped out a fence around the shul. But demolition resumed the following June, when two excavators ripped up a stone walkway, buried septic tank, fence and curb.

That dispute and the lawsuit are reminiscent of a battle Waldman and his fellow dissidents waged in the 1990s over another synagogue.

That conflict also snowballed into a federal civil-rights case — brought by Sussman — that ended in 1997 with the shul staying open and the village agreeing to pay $300,000.

Sussman made an analogy to that earlier case during Monday's news conference, saying that dissidents had once again turned to a higher venue to redress their grievances.

"The state courts wouldn't hear about it," he said. "But the federal courts will."

JEWISH WEEKLY STORY ON SQUARE AND KJ

Chasidic Dissidents

Press Cases In Court

Tuesday, June 14, 2011
Stewart Ain
Staff Writer

The leadership of two chasidic communities came under legal attack this week, the most serious being a lawsuit seeking the dissolution of the Village of Kiryas Joel in Orange County.

In a 59-page suit filed in Manhattan Federal Court, the Kiryas Joel Alliance and several of its members, who describe themselves as ''dissidents'' within the Satmar village, claimed that the village's ''majority religious faction has irretrievably commandeered the village government and uses it to advance the congregation's agenda.''

The second suit comes following an internal quarrel within the Skver chasidic community in Rockland County's New Square. The $36 million suit filed in state court names as defendants New Square's grand rebbe, David Twersky, and an 18-year-old, Shaul Spitzer. The suit alleges that Spitzer, at the direction of Rabbi Twersky, started a fire in the home of Aron Rottenberg, 43, because he refused to pray in the main synagogue at which Rabbi Twersky presides.

Both suits were filed Monday by Michael Sussman of Goshen, N.Y., who said he represented the same group of Kiryas Joel dissidents in a 1997 suit against the village. In that suit, the dissidents claimed they were subject to a sometimes violent campaign of religious persecution. The case ended with the village, about 50 miles north of Manhattan, reportedly agreeing to pay the dissidents $300,000.

Sussman said that during that trial the court ''said the evidence suggested'' that the village should be dissolved.

''It didn't happen because we were not seeking that,'' he said.

Asked why he waited 14 years to pursue it, he replied: ''The situation has worsened.''

The 1997 case was reportedly settled to avoid the embarrassment of putting on the witness stand Rabbi Aron Teitelbaum, the spiritual leader of Kiryas Joel and the son of the grand rabbi of the Satmar chasidim, which with a reported 50,000 followers is the largest chasidic group.

Samuel Heilman, a professor of sociology at Queens College who has written extensively about the fervently Orthodox, suggested that it is no coincidence that both suits were filed by Sussman, ''a civil rights lawyer who is a busy political activist and has a long history'' of pursuing liberal causes and cases involving separation of church and state.

He noted that three months after the Kiryas Joel settlement in 1997, Sussman successfully sued to compel Kiryas Joel to move the voting booths from the basement of the main synagogue because dissidents said they were harassed when they went to vote.

''This is a guy who has an agenda, who does not like the idea of the right wing and wants to separate state and religion,'' Heilman said.

He said the group of dissidents who filed the Kiryas Joel suit are followers of Grand Rabbi Joel Teitelbaum, the founder of Kiryas Joel in 1977. His nephew, Moshe Teitelbaum, succeeded him when he died in 1979, although the dissident group remained loyal to Rabbi Joel Teitelbaum's widow, Feige.

After Rabbi Moshe Teitelbaum died in 2006, another split occurred over his successor, with the KJ favoring his son Aron and others favoring his son Zalman. Sussman said he believes some of those supporting his suit are supporters of Zalman.

William Helmreich, a professor of sociology at the CUNY Graduate Center and a close observer of the Orthodox community, said the rivalry between the factions in Kiryas Joel is well known.

''Let them remember the old saying that when it starts raining, everyone gets wet,'' he said. ''They may bring down calumny on both their houses if they keep this up. … Rational thinking ends when emotions take control. Here they are willing to engage in self-destructive behavior. If they would stop and count to 10, they would realize they are hurtling towards disaster for their own community.''

Heilman added that the idea of seeking the village's dissolution is ''one more tactic in the ongoing conflict between the various streams. … What you are seeing here is the old dispute that has been festering.''

The Kiryas Joel suit charges that the majority who rule the village engage in religious discrimination by selectively enforcing laws to their own benefit. Among other things, the suit alleges that the village disparately treats dissidents with regard to taxes, municipal fees and enforcement of building and zoning codes, and selectively enforces littering, noise and public order ordinances.

''Dissolution of the village is warranted because of the inherent and unwavering conflict that exists in the village … between the rule of law in a secular democratic society and theocratic rule, which gives primacy and credence to the edicts of a single religious leader without respect to judicial boundaries,'' the suit says.

As the dissidents represent about 40 percent of the 20,000 residents of Kiryas Joel and that the village's public safety officers have overlooked instances of violence and harassment directed at the dissidents. For instance, village residents who opt to use a wedding hall not sanctioned by the majority have had their names, pictures and private phone numbers plastered on leaflets that are distributed throughout the community. They often receive harassing phone calls, including during the middle of the night.

''If not directly calling for violence, in fact, [they] do incite violence against the 'dissidents,''' the suit said. ''Within the past few years there have been several incidents involving mobs of hundreds of [yeshiva] boys, harassing and assaulting 'dissident' members. When these mobs convene, [the public safety officers] often do not intervene but rather allow the boys to continue unhindered, forcing the 'dissidents' to call the state police to obtain relief.''

The suit, which cited examples of discrimination going back a decade, noted that last August a family of 10 to 12 people — including a woman who was pregnant — were returning from a post-wedding celebration when a ''mob of about 300 [yeshiva] boys'' surrounded them and, while family members tried to escape, ''the boys were hitting and kicking them, throwing bottles and eggs and calling [the man's daughter] a Yiddish term roughly equivalent to 'prostitute,' but carrying an even more negative religious connotation.''

Dissolving the village would place it under the governance of the Town of Monroe. Should the court not opt to pursue that option, the suit asks that it enjoin the village and its leaders from selectively enforcing the laws and that it remove the current village leaders, including Mayor Abraham Weider, the trustees and the director of public safety and bar them for holding any village office indefinitely.

In the New Square suit, it was alleged that Rottenberg had been harassed since September because of his refusal to pray in the community's main synagogue. The suit contends that Rabbi Twersky condoned the ''aggressive behavior'' against Rottenberg, which included expelling his daughter from the religious school she attended, ''throwing stones and rocks through the car windows and plaintiffs' residence, and making threatening phone calls to plaintiffs' residence.''

It said the goal of setting fire to Rottenberg's home on May 22 was to ''run [him] out of the Village of New Square'' and that Spitzer was ''acting at the direction of the Grand Rebbe, in whose home he lived.''

Rottenberg was severely burned when he spotted Spitzer, who ignited an accelerant and the two men struggled, the suit said. Rottenberg's son, Jacob, was also burned, it said.

The separation of church and state is at the heart of a suit whose outcome could have the effect of dissolving the Satmar Hasidic Village of Kiryas Joel. Plaintiff and dissident leader Joseph Waldman speaks to the news media Monday while attorney Michael Sussman looks on.

By Chris Mckenna
Times Herald-Record
Published: 2:00 AM - 06/19/11

Kiryas Joel dissidents rolled the ultimate grenade into their enemies' tent last week with a federal lawsuit questioning the very existence of the village that the Satmar Hasidic community created 34 years ago.

Their argument — laid out by civil-rights attorney Michael Sussman and sharply disputed by village leaders and their supporters — is that the village discriminates against them because of religious differences, and that public and religious authority are so entwined in Kiryas Joel that it violates the constitutional separation of church and state.

But even if the plaintiffs prove they've been thwarted and unfairly treated as they allege, a big question is whether a judge would ever order the drastic remedy they proposed: dismantling the Village of Kiryas Joel.

Stolzenberg contends the case could hinge on which of two constitutional readings the judge uses.

The prevailing approach would likely find that the institutions of church and state are separate in Kiryas Joel, and therefore, permissible, she said. But a competing doctrine — she calls it the "get real" approach — might take a less lenient view.

"It's actually hard to predict how the federal judges are going to react to this," she said.

The dissidents' lawsuit tries to show unequal treatment in law enforcement, tax exemptions, elections and other areas through a series of examples. Village leaders say the claims have no merit, and insist they provide services to all residents without discrimination.

Joseph Waldman, a plaintiff in the case and a longtime thorn in the side of the village's leadership, brought a similar case in 1997 to try to get the village dissolved. A federal judge and then an appeals-court panel rejected his demand — but strictly because most of his allegations had just been tried in two previous lawsuits.

The appeals-court judges wrote that Waldman's claims didn't "establish the sort of pervasive and otherwise irremediable entanglement between church and state that would justify a drastic remedy like the dissolution of the village."

But they added:
"All this is not to say that a series of future actions evincing an enduring and all-encompassing domination of the Village government by the Congregation could not at some point suffice to create a new cause of action for the dissolution of the village
."

city of rajneeshpuram

One of the few precedents for the constitutional challenge Kiryas Joel dissidents have brought against their village is a 1983 case involving Rajneeshpuram, a religious enclave incorporated as a city in Oregon the previous year.

The community started in 1981, when followers of a spiritual leader named Bhagwan Shree Rajneesh bought a huge ranch in Wasco County. Within only three years, their commune grew into a city of 7,000 with its own police and fire departments, businesses and bus system.

By that time, the state had sued Rajneeshpuram in federal court, arguing that it had no obligation to recognize the municipal status of a city controlled by a religious organization.

A federal judge ruled in favor of Oregon in 1985. But the decision had little impact on Rajneeshpuram, because state and federal court battles had so depleted the group's resources that the city was soon bankrupt and empty.

The answer depends on whom you ask.

Ralph Stein, a Pace Law School professor who teaches constitutional law, sees no chance of that happening, based on what he read in the court complaint.

"As far as I'm concerned, it's a political polemic," Stein said. "It doesn't provide a legal basis for which the relief can be provided."

If the allegations are true, Stein said, what the dissidents are complaining about amounts to political corruption no different than Tammany Hall-style tactics, even if cloaked in religious garb. And corruption, he said, is no reason to dismantle a municipality.

If it were, Stein said, "I can't imagine how many times places like Boston, New York and Chicago would have been dissolved."

But Nomi Stolzenberg, a University of Southern California law professor who's co-writing a book on Kiryas Joel, argues that a political in-group abusing power for non-religious reasons is different under constitutional law than a "religious in-group that uses political power to suppress religious dissenters."

"Whether that in fact is what's going on in Kiryas Joel remains to be proved," she said. "But the idea that a religious group could capture political power and abuse its power by discriminating against groups that don't adhere to the beliefs of the dominant group — that is a very specific danger that the religion clauses were designed to combat."

The Curious Case Of Kiryas Joel: Is New York Harboring A Mini-Theocracy?

June 21st, 2011

Visitors to the village of Kiryas Joel, N.Y., might be forgiven for believing they have stepped into a mini-theocracy.

There are no theocracies in America, right? After all, we have constitutionally mandated separation of religion and government.

Perhaps not. A village in New York called Kiryas Joel appears to be going right up to the line – and perhaps lurching over it. An interesting case just filed in federal court will test the ability of a religious group to actually run an entire town.

Kiryas Joel is an enclave of ultra-orthodox Jews who belong to the Satmar Hasidic sect. Members of this group believe in separating themselves from others – they'd rather not be around non-sect members. Thirty-four years ago, they won the right to create their own village from the surrounding community of Monroe.

The village's founders might have envisioned an idyllic community where people of a shared faith lived in harmony. It hasn't worked out that way. As often happens when people live in insular communities, factions emerge. Dissidents in Kiryas Joel don't like the way the town of about 20,000 is being run. The dissidents, who by some accounts now make up 40 percent of the community, say religious discrimination is rampant. They say if you don't belong to the right synagogue, you're a second-class citizen.

A local newspaper, the Times Herald-Record in Middletown, N.Y., reported, ''The case alleges discrimination against dissidents…in various facets of public life, from tax exemptions for synagogues to election improprieties to selective enforcement of village noise ordinances. Among the most serious allegations is that Kiryas Joel's Public Safety Department, a quasi-police agency, has acted as enforcers for the main congregation and tolerated acts of violence and intimidation against dissidents by unruly crowds of young supporters of Satmar Grand Rebbe Aron Teitelbaum, the leader of Kiryas Joel's majority faction.''

It's tempting to dismiss this as an internecine squabble among members of a small religious group. It's not that simple. The Satmar group may not be large, but its members are politically savvy. In 1989, they successfully lobbied the New York legislature for their own ''public'' school system.

The Satmars didn't want their children to be educated alongside non-Satmars. For most Satmar families, this wasn't a problem since their children attend private religious academies. But the community lacked the resources to educate its special-needs children. The New York legislature's answer was to give the village its own public school, with boundaries drawn in such a way that all non-Satmars were excluded.

The U.S. Supreme Court struck down the scheme in 1994, but New York lawmakers quickly began brain-storming other ways to keep the school open. More litigation ensued. Two other laws were struck down by the courts before the legislature finally crafted a measure that passed constitutional muster.

How did a little community gain such influence? The New York Times explained earlier this year that while Kiryas Joel is a poor community, it has discovered the secret of getting a lot of attention from politicians: ''Because the community typically votes as a bloc, it wields disproportionate political influence, which enables it to meet those challenges creatively.''

Meanwhile, visitors to Kiryas Joel might be forgiven for believing they have stepped into a mini-theocracy. A sign at the village entrance admonishes visitors to dress modestly. Cleavage-revealing tops for women are verboten, and both sexes are told to cover arms and legs. Couples are advised to ''maintain gender separation in public places.''

The sign was erected by the town's largest synagogue. Its wording is tough, but in fact the village can't legally enforce rules like this. Still, women who dare to visit the community while wearing skimpy summer outfits have reported scowls and glares. (Imagine the reaction from the Religious Right if this were a town of fundamentalist Muslims and they erected a sign reading, ''Women are welcome to visit if accompanied by a male relative. Please respect our values by wearing a burqa.'')

I realize the Satmars want to live on their own (although they've chosen an odd place to do that – just 50 miles north of New York City), but that does not give them the right to use government as a device to enforce religious conformity. Nor does it give them the right to create an insular theocracy. Our Constitution doesn't allow that.

The lawsuit has already achieved some of its goals by shining light on questionable practices in this enclave, and there may be more revelations as the case moves forward. This situation doesn't pass the constitutional smell test. It definitely bears watching.

Kiryas Joel: Theocracy in America

This past Monday, Federal Judge Jed Rakoff of the Southern District of New York issued a major, press-worthy ruling in which he voided the $285 million settlement that the Securities and Exchange Commission had forged with Citigroup. Much less noticed was another decision by Judge Rakoff rendered the same day. He turned back efforts by a group of self-described "dissidents" to dissolve the community in which they live: Kiryas Joel, N.Y.

Kiryas Joel is a legally recognized municipality about 50 miles outside of New York City in Orange County. Its population of 22,000 residents is made up almost entirely of members of the Satmar branch of Hasidic Judaism. To the outside world, Kiryas Joel appears as an island of uniformity; bearded men wear dark suits and hats, and bewigged women wear long sleeves and skirts. Owing to the extraordinarily high birth rate, the community's children under the age of 18 make up an astonishing 60% of the population, three times the percentage in New York state. With this kind of demographic uniformity and density, the community has been able to inculcate the distinctive values of traditionalist Orthodoxy -- ritual stringency, endogamy and lifelong Torah education. The community's particular social norms are reflected in a welcome sign that greets visitors to Kiryas Joel, asking them to dress modestly, use appropriate language and even "maintain gender separation in all public areas."

In this regard, Kiryas Joel would seem to represent a great success story, indeed, the fulfillment of the vision of the community's first leader, Satmar Grand Rabbi Joel Teitelbaum (1887-1979), after whom the village was named. It was Rabbi Teitelbaum's dream to build a community outside of Williamsburg, Brooklyn, where he had settled in 1946 with several dozen followers after the Holocaust. There it would be possible not only to provide adequate housing to the rapidly growing families of the Satmar community, but to escape the seductions and dangers of big-city life in Brooklyn. Rabbi Teitelbaum's long-standing desire to create a "shtetl," by which he intended a site of insular purity, prompted his lieutenants to search out available property in the New York metropolitan area for decades. Finally, in 1974, land began to be purchased and the first Satmar settlers arrived in the Town of Monroe, N.Y. Initially, the community's leaders did not want to incorporate as a village, and thereby assume full responsibility for the social services and finances of Kiryas Joel. But constant tensions over zoning issues between Monroe Town officials and the new Hasidic residents ultimately led the Satmar Hasids to seek -- and gain -- incorporation in March 1977. At that point, a religious enclave, comprised of private landholders, became a legally recognized public square -- a local government of, by and for the community of Satmar Jews.

Abundant signs attest to the community's rapid growth, none more than the fact that it doubles in population every 10 years. But in certain key respects, the idyll of Kiryas Joel began to unravel shortly after its birth. Rabbi Teitelbaum died in 1979, setting off a series of bitter succession battles that now embroil two great-nephews, Aron and Zalman Teitelbaum. Over the course of those battles, the "dissidents," now loosely aligned with Rabbi Zalman, have sought to diminish the power of the mainstream establishment faction, now under the control of Rabbi Aron. These efforts have even prompted the dissidents to seek the formal dissolution of the Village of Kiryas Joel on a number of prior occasions, in 1994 and 1999-2000. Represented by former NAACP Legal Defense Fund lawyer Michael Sussman, the dissidents filed suit again in 2011 alleging that Kiryas Joel is a "theocracy" whose "very existence" stands in violation of the Establishment Clause of the First Amendment.

Judge Rakoff threw out the dissidents' suit on both procedural and substantive grounds. He reasoned that a number of claims advanced by the plaintiffs had already been heard and dismissed, and thereby failed the standard of res judicata. He also argued that a number of those alleging injury were in fact non-parties to the suit, and thus had no standing.

On the substance of the matter, Judge Rakoff wrestled directly with a series of interlocking claims that the Village not only permits, but is a form of state-based establishment of religion. The plaintiffs argued that the Village's "governmental affairs are impermissibly intertwined with those of Congregation Yetev (i.e., the synagogue of Chief Rabbi Aaron Teitelbaum)." All Village officials, they continued, are members of the Congregation. More particularly, the Village Mayor serves as Head of the Congregation, effectively erasing the boundary between state and synagogue.

The plaintiffs also alleged that the Village requires all developers of multi-family dwellings in the Village to construct a Community Room or else face a $5,000 per unit fine. The primary purpose of the Community Room law, the dissidents claim, is "to advance religion," since its serves principally as a venue for religious activities. Together, the plaintiffs claimed, the various actions on the part of local officials rendered the Village, in substance, if not in form, a "theocracy."

Judge Rakoff roundly rejected this claim. Responding to the argument about the permeable boundary between the Village and the Congregation, he invoked two earlier cases: McDaniel v. Paty, a case from 1978, in which the Supreme Court held that "the Establishment Clause does not bar an individual from holding public office simply because he is a member of the Clergy," and Kiryas Joel v. Grumet, a 1994 decision that addressed the constitutionality of municipal institutions in Kiryas Joel. Grumet struck down a New York statute creating a public school district in Kiryas Joel. It is often mistakenly viewed as having condemned the kind of fusion of religious and political establishments that exists in the Village. In fact, it did nothing of the kind. Rather, it affirmed the core principle of McDaniel -- that individuals are not barred from holding public office by virtue of their religious beliefs -- and extended it by explicitly stating that a community is not disqualified from establishing its own local government institutions merely because the residents of the community happen to be members of the same religious community.

Relying on these precedents, as well as the more recent case of McCreary County v. ACLU, in which a narrow majority of the Court struck down a public display of the Ten Commandments, Judge Rakoff dismissed the argument about the porous boundary between religion and politics in Kiryas Joel. He proved somewhat more sympathetic to the claim about the Community Room law, and left open the prospect for the plaintiffs to amend their suit to demonstrate actual injury issuing from the law. But, at the end of the day, and despite the hopes and expectations of the plaintiffs, Judge Rakoff upheld the legal validity of Kiryas Joel, New York. In doing so, he rejected the proposition that the Village constitutes an impermissible "theocracy," and affirmed, perhaps unintentionally, another well-established American tradition: the granting of government sanction to strong forms of religious sub-communities, even (or perhaps especially) those whose norms of governance and behavior are illiberal and seemingly in contradiction to American constitutional values and norms.

To be sure, the term "theocracy" is a loaded one in contemporary political discourse, largely because it is most commonly used to conjure up the fear of a radical, nuclear-tipped Islamic polity. The courts, certainly, have not given any fixed meaning to the term, and it remains unclear just what a "theocracy" is, let alone when, if ever, theocratic government is proscribed. What is clear is that American constitutional law does not necessarily condemn the establishment of governments by, for and of a particular (illiberal, religious) sub-community. American courts have repeatedly approved the formation of private self-governing enclaves by religiously homogeneous communities. Kiryas Joel thus falls into a long American tradition of robust support for religious sub-communities, a tradition that enables private communities to form and then, once formed, to translate their private power into political power. Judicial respect for the autonomy of religious sub-communities has been expressed in a number of important decisions, most notably, the case of Wisconsin v. Yoder (1972), in which the Supreme Court affirmed the right of the Amish to protect their insular, communitarian and pervasively religious way of life by not sending their children to school.

This is not to say that America's constitutional culture is unambivalently committed to protecting the rights of religious groups to form their own self-governing enclaves. Far from it, as the history of the Mormon Church amply illustrates. Indeed, the Mormons' history of confrontation with the federal government is the sharpest rejoinder to the claim that the Constitution protects the right of religious subgroups to form their own governments. From the moment of its inception, throughout the 19th century, the U.S. government waged a relentless campaign to stamp out the Mormon Church and, above all, to prevent it from establishing its own state government. The Supreme Court strongly sided with the government's actions. Despite this campaign, the Mormon Church not only survived, but thrived. More to the point, in the end it succeeded in founding its own state: Utah, a place not just of refuge from persecution, but of active self-governance through the formation of state and local government institutions that answer to the values and preferences of the local (Mormon) population.

Does that make Utah a "theocracy"? The answer to that question turns on semantics. Some who deny that claim will note that non-Mormons are free to live -- and vote -- in Utah. Similarly, non-Satmars are free as a matter of American law to live and vote in Kiryas Joel; nor is there a Village ordinance barring non-Satmars or denying them equal rights. That said, there is intense pressure within the community to avoid selling or renting to those who do not adhere to a strictly observant lifestyle. Moreover, there can be little doubt that the ultimate authority in matters spiritual and temporal is Rabbi Aron Teitelbaum. Defying his word has real consequences in the Village's civil and religious life, which indeed are so entwined as to be indistinguishable. We might say that this is a most regrettable violation of the vaunted doctrines of liberalism on which this Republic was built. But one must also ask whether Kiryas Joel does not in fact attest to another long-standing American tradition -- the potent strain of communitarianism -- which permits difference and segregation, not least religious difference and segregation. Seen from that angle, Kiryas Joel, N.Y., may be as American as apple pie.
