Borough Park, NY - Appellate Court Revised Lower Court Ruling in Satmar Real Estate Dispute
Borough Park, NY - In the ongoing leadership dispute and in the Satmar Communty of Borough Park, is a case concerns competing claims to control of the Board of Trustees of the United Talmudic Academy of Borough Park. which includes the Boys and Girls School.
The NYS Supreme Court second Appellate Division ruled on the case of Welz vs Schwimmer
The 4 judges reversed a lower court Sept 06 ruling, and said that the dispute is a business matter and not a religious matter therefor the lower court should rule the case.
The courts previously determined that the R' Zalman Leib's faction controls the synagogue corporation (Yetev Lev) and the property in Williamsburg.
Rabbi Aaron's faction attempted to replace the board of the UTA in Boro Park, which was also controlled by people loyal to Rabbi Zalman Leib. The lower court decided that it could not decided who controlled UTA of Boro Park because the decision involved religious matters.
The Appellate Court decided that ''membership on the board is not conditioned upon any religious criteria'' and that the lower court should have made a decision. Barring an appeal, the matter will now be returned to the lower court and the judge will have to examine the facts and come to a decision.
